1. Introduction

Welcome to Yaad Logistics. These Terms and Conditions govern your use of our services, website, and mobile applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our Services.

Yaad Logistics ("we," "our," or "us") is a courier and logistics company operating in Kingston, Jamaica, providing shipping, delivery, and related services.

2. Acceptance of Terms

By creating an account, submitting information to us, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy.

3. Service Description

Yaad Logistics provides courier and logistics services, including but not limited to:

  • Package pickup and delivery
  • Freight shipping
  • Express delivery
  • International shipping
  • Tracking services
  • Warehousing and storage

Service availability may vary by location, and we reserve the right to modify, suspend, or discontinue any aspect of our Services at any time.

4. User Accounts

To use certain features of our Services, you may need to create an account. When you create an account, you agree to provide accurate, current, and complete information, including your name, Tax Registration Number (TRN), email address, phone number, and valid identification for verification purposes.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

5. User Responsibilities

When using our Services, you agree to:

  • Provide accurate and complete information about yourself and your shipments
  • Properly package items for shipping according to our guidelines
  • Comply with all applicable laws and regulations, including customs and import/export regulations
  • Pay all applicable fees, duties, and taxes associated with your shipments
  • Not use our Services for any illegal or unauthorized purpose
  • Not infringe on the rights of others or violate any laws through your use of our Services

6. Prohibited Items

You agree not to ship any of the following prohibited items:

  • Illegal substances or items
  • Hazardous materials, including flammable, explosive, or corrosive substances
  • Firearms, weapons, or ammunition
  • Perishable goods that may spoil during transit (unless specifically arranged)
  • Live animals or plants (unless specifically arranged and permitted by law)
  • Counterfeit goods or items that infringe on intellectual property rights
  • Currency, cash, or other monetary instruments (unless through authorized services)
  • Any items prohibited by law in Jamaica or the destination country

We reserve the right to refuse, return, or dispose of any shipment containing prohibited items, at our discretion and at your expense.

7. Payment Terms

You agree to pay all fees and charges associated with our Services at the rates in effect when the charges are incurred. Payment must be made in Jamaican Dollars (JMD) unless otherwise specified.

We accept various payment methods, including credit cards, debit cards, and bank transfers. For business accounts, we may offer credit terms subject to approval.

All fees and charges are non-refundable unless otherwise specified or required by law. We reserve the right to change our prices at any time, with or without notice.

8. Shipping and Delivery

Delivery times are estimates only and are not guaranteed unless expressly stated otherwise. We are not responsible for delays caused by customs clearance, weather conditions, natural disasters, or other circumstances beyond our control.

You agree to provide accurate delivery information, including the recipient's name, address, and contact information. We are not responsible for delivery failures due to incorrect or incomplete information.

For deliveries requiring signature, we may obtain an electronic signature or other form of delivery confirmation. If no one is available to receive the shipment, we may leave a notice and attempt delivery again or hold the shipment for pickup, according to our delivery policies.

9. Liability Limitations

Our liability for loss, damage, or delay of shipments is limited to the declared value of the shipment or the actual value of the shipment, whichever is less, up to a maximum of JMD 10,000 unless additional insurance is purchased.

We are not liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Damage or loss due to improper packaging
  • Damage or loss of prohibited items
  • Delays caused by customs, weather, or other circumstances beyond our control
  • Any claims not reported within 7 days of delivery or expected delivery date

10. Claims Process

To file a claim for lost or damaged shipments, you must:

  • Notify us within 7 days of delivery or expected delivery date
  • Provide the tracking number and shipment details
  • Submit evidence of the value of the shipment
  • Provide photographs of damaged items and packaging, if applicable
  • Complete our claim form with all required information

Claims will be processed within 30 days of submission of all required documentation.

11. Intellectual Property

All content on our website and mobile applications, including text, graphics, logos, icons, images, audio clips, and software, is the property of Yaad Logistics or its content suppliers and is protected by Jamaican and international copyright laws.

You may not use, reproduce, modify, or distribute any of our intellectual property without our express written permission.

12. Termination

We reserve the right to terminate or suspend your account and access to our Services at any time, without notice, for any reason, including but not limited to violation of these Terms and Conditions.

13. Dispute Resolution

Any disputes arising from or relating to these Terms and Conditions or our Services shall be resolved through good faith negotiations. If negotiations fail, disputes shall be submitted to binding arbitration in Kingston, Jamaica, in accordance with the Arbitration Act of Jamaica.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our Services after any changes indicates your acceptance of the modified Terms and Conditions.

16. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
